By creating an account or using our platform, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use Vixdo.

Vixdo is an independent third-party platform that provides access to AI video generation technology through API integration. We utilize OpenAI's Sora 2.0 API as our technical provider for video generation capabilities.

We are NOT:

• Affiliated with, endorsed by, or sponsored by OpenAI
• An official OpenAI product or service
• Authorized to represent OpenAI in any capacity

OpenAI, Sora, and all related trademarks are the exclusive property of OpenAI, L.P. Vixdo provides a user interface, credit management system, and customer service as an independent software platform.

Definitions

• "Service" refers to the Vixdo platform, including the website, APIs, and all related Sora2 video generation services powered by OpenAI Sora 2.0 API
• "User," "you," or "your" refers to any individual or entity using the Vixdo Service
• "Content" refers to text prompts, videos, and any other materials uploaded or generated through our Service
• "Credits" refers to the virtual currency used to pay for AI video generation on our platform

Use of the Service

Eligibility

You must be at least 13 years of age to use our Service. By using the Service, you represent and warrant that you meet this age requirement.

Account Registration

To use most features of our Service, you must:

1. Create an account using Google OAuth authentication
2. Provide accurate and complete registration information
3. Maintain the security of your account credentials
4. Notify us immediately of any unauthorized access to your account

You are responsible for all activities that occur under your account.

Acceptable Use

You agree to use our Service in accordance with all applicable laws and regulations. You agree NOT to:

• Upload or generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Violate any intellectual property rights of others
• Attempt to reverse engineer, decompile, or extract the source code of our AI models or underlying AI technology
• Use automated systems (bots, scripts) to abuse our free trial or credit system
• Circumvent any security features or access controls
• Generate content that depicts illegal activities, violence, or explicit sexual content
• Use the Service to harm, harass, or impersonate others
• Attempt to overwhelm our servers or infrastructure (denial of service attacks)

We reserve the right to suspend or terminate accounts that violate these acceptable use policies.

Credit System and Pricing

Credit Purchase

• Credits are purchased through our payment processor (Stripe/Creem)
• All credit purchases are final and non-refundable
• Credits never expire once purchased
• Credit packages and pricing are displayed on our Pricing page

Credit Usage for AI Video Generation

All AI video generation services cost 70 credits per generation, which includes:

• 720p or 1080p resolution options
• 5-second duration
• Fast generation (typically 10-30 seconds)

We reserve the right to adjust pricing with at least 30 days notice to existing users.

New User Bonus

New users receive 70 credits upon account creation. This is a one-time bonus and cannot be combined with other promotional offers.

Free Trial

• First-time visitors may use our AI video generation service once without creating an account
• Free trial is limited to one use per device/IP address
• We use device fingerprinting to enforce this policy
• Attempting to abuse the free trial system may result in permanent ban

Content and Intellectual Property

Your Content

• Ownership: You retain all rights to the text prompts you upload to our Service
• License to Us: By uploading content, you grant us a limited license to process and store your content solely for the purpose of providing the AI video generation Service
• Responsibility: You are solely responsible for ensuring you have the right to upload and use any content you provide

Generated Videos

• Ownership: You own the videos generated through our service
• Commercial Use: You have full rights to use AI-generated videos for any purpose, including commercial use
• No Warranty: While our AI produces high-quality results, we do not guarantee that generated videos will meet your specific requirements or be free from AI artifacts

Our Intellectual Property

• The Vixdo platform, website design, and branding are our exclusive property
• The underlying AI video generation technology and related intellectual property belong to their respective owners
• You may not copy, modify, distribute, or create derivative works based on our platform
• You may not remove any copyright or proprietary notices from the Service

Vixdo Sora2 Video Generation Service

Service Availability

• We strive to maintain 99% uptime but do not guarantee uninterrupted service
• We may perform scheduled maintenance with advance notice when possible
• AI video generation typically takes 10-30 seconds but may vary based on server load and complexity

Content Storage

• Generated Videos: Stored in your generation history for 30 days, then automatically deleted
• Backup: We recommend downloading and backing up any videos you wish to keep permanently

AI Processing

• Video generation is powered by advanced AI models
• We continuously work to improve model quality and capabilities
• AI output may vary based on model updates and improvements
• We do not guarantee specific output characteristics or aesthetic preferences

AI Technology Limitations

• AI-generated videos may contain artifacts, inaccuracies, or unexpected results
• Physics simulation, while advanced, may not always perfectly match real-world physics
• Generated content quality depends on prompt clarity and complexity
• Some prompts may produce better results than others

Privacy and Data Protection

We collect and process your personal information as described in our Privacy Policy. By using our Service, you consent to such collection and processing.

Key points:

• We use Google OAuth for secure authentication
• Your text prompts are processed by our AI video generation system
• We store your generation history and credit transactions
• We use device fingerprinting solely for free trial enforcement
• We do not sell or share your personal data with third parties (except service providers like AI services, Cloudflare, payment processors)

Payment Terms

Payment Processing

• Payments are processed securely through Stripe or Creem
• We do not store your credit card information
• You agree to pay all charges associated with your purchases

Refund Policy

• Credit purchases are non-refundable
• If technical issues prevent AI video generation, we will refund the credits used for that specific generation
• Refund requests must be submitted within 7 days of the transaction

Pricing Changes

• We reserve the right to modify pricing at any time
• Changes will not affect credits already purchased
• Significant pricing changes will be announced at least 30 days in advance

Prohibited Content

You may NOT use our service to generate:

• Content depicting illegal activities or promoting violence
• Content that violates intellectual property rights (e.g., trademarked characters)
• Explicit sexual or pornographic content
• Content intended to harass, bully, or harm others
• Deepfakes or misleading content impersonating real people without consent
• Content that violates any applicable laws or regulations
• Content intended to spread misinformation or disinformation

We reserve the right to remove content and terminate accounts that violate these policies.

Disclaimers and Limitations of Liability

Service Disclaimer

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Warranties of merchantability or fitness for a particular purpose
• Warranties regarding accuracy, reliability, or quality of AI-generated content
• Warranties that the Service will be uninterrupted or error-free
• Warranties regarding the performance of AI video generation models

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIXDO SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, or business opportunities
• Damages arising from your use or inability to use the Service
• Damages arising from AI-generated content or any reliance thereon
• Any issues arising from AI video generation models or their output

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM.

AI-Generated Content Disclaimer

• AI-generated videos may contain inaccuracies, artifacts, or unexpected results
• We are not responsible for how you use or interpret AI-generated content
• You should review and verify all generated content before using it for important purposes
• Our AI technology and its output may not always align with your expectations

Indemnification

You agree to indemnify, defend, and hold harmless Vixdo and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including intellectual property rights
• Content you upload or generate through Vixdo
• Your misuse of AI-generated content

Termination

By You

You may terminate your account at any time through your account settings. Credits are non-refundable upon account termination.

By Us

We reserve the right to suspend or terminate your account at our sole discretion, without notice, if:

• You violate these Terms or our acceptable use policies
• We suspect fraudulent or abusive activity
• Required by law or legal process
• Continued provision of Service would be unlawful or harmful to us or others
• You generate prohibited content

Effect of Termination

Upon termination:

• Your access to the Service will be immediately revoked
• We will delete your personal data within 30 days (except as required by law)
• You will lose access to any remaining credits (no refunds)
• These Terms will continue to apply to any disputes or claims arising before termination

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions.

Dispute Resolution

For any disputes arising from these Terms or the Service:

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vixdo regarding the Service.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

No Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to third-party service disruptions.
